179 বাংলাদেশের স্বাধীনতা যুদ্ধ দলিলপত্রঃ দ্বিতীয় খন্ড 2. Amendment of section 2, Act III of 1952. -In the Political Parties Act 1962, hereinafter referred to as the said Act, in section 2, for clause (c) the following shall be substituted, namely: (c) "Political Party" includes a group or combination of person who are operating for the purpose of propagating any political opinion or indulging in any other political activity, (Amendment by Ordinance No. 1 of 1963) 3. Formation of certain political parties prohibited.— (1) No political party shall be formed with the object of propagating any opinion, or acting in a manner, prejudicial to the Islamic ideology, or the integrity or security of Pakistan. (2) No person shall form, organize, set up or convene a foreign aided party or in any way be associated with any such party. 4. Lawful political activities. -Subject to the provisions of section 3, it shall be lawful (1) for anybody of individuals or association of persons to form, organize or set up a political party; (2) for any person to be a member or office bearer of, or be otherwise associated with, a political party; or (3) for any person, for the purpose of an election to be held under the Constitution, to hold himself out or any other person as a member, or to have the support, of a political party, the formation, organization or setting up of which is not prohibited by this Act. 3. Amendment of section 5, Act III of 1962.--In section 5 of the said Act, for sub-section (1) the following shall be substituted, namely: "(1) No person who is disqualified under sub-section (2) shall be a member or office bearer of, or otherwise associate himself with any political party." (Amendment by Ordinance No. 1 of 1963) 2. A person shall be disqualified for being a member or office bearer of a political party (a) if he has been convicted of any offence and sentenced by an ordinary court of law to transportation or to imprisonment for not less than two years, unless a period of five years has elapsed since his release; (b) if he has been disqualified from holding public office under Article 121 or Article 122 of the Constitution, unless the period of his disqualification has expired; (c) if he has been dismissed from the service of Pakistan, unless a period of five years has elapsed from the date of his dismissal; or From Pakistan Gazette, Extraordinary, Monday.
