B Musst. Zobesda Khanum, Pantoff– Petitzooper Vergus Lutsonissa Begum and others—Defendants. This was a summary appeal from an order of the Prineipul Sudder Ameen of Backergunge, dated 14th December, 1846, declaring the suit of the petitioner to be dismissed by reason of default under the provisions of Act XXIX. 1841. The suit had been pending in the Court of the Principal Sudder Ameen, for a period of two years when the defendants urged that the plaintiff had been guilty of various defaults on the earlier stages of the proceedings, and claimed a dismissal under the Act abovementioned.
