so { Clerk to the said Commissioners by delivering the same to him, or leaving it at his office by the perintending to build or re-ould such house, or to make such drain, and every such foundation shall he laid at such level as the said Surveyor of the said "Commissioners shall direct, and every such branch drain shall be made in such direction, man ner and form, and of such Inaterials and workmanship as the said Surveyor shall onder, and the mnking of every such drain shall be under the survey and rontroul of the suid Commissioners; and in default of such notice, or ti such building or drain shall be begun or made without or in any respect contrary to any order of the said Surveyor, or of the provisions of this Act, it shall be lawful for the said Commissioners to cause such building to be demolished, and to cause such drain to be relaid, amended or reinade as the case may require, and to cause the expenses thereof to bo levied and repaid to them from and by the Owner thereof in the manner hereinafter provided. XIX. And it is enacted, that it shall be lawful for any person at his own expence to Inake or branch any drain into any of the sewers vested in the said Commissioners, or authorized to be made by virtue of this Act, or otherwise acquired by the said Commissioners, such drain being made of such a size and in such manner of cominunication in all respects as the said Surveyor of the said Commisstomers sl.ill direct or appoint, and for that purpose to t., ke up and remove so much of the pavement and other matel sals of any street, as may be requii ed unless the said Conimissioners shall consent and agree, which they are hereby authorized to do, to form so much and such portion of such drain as shall lead from the point of communication in such sewer to the extremity of such street, and in case any person shall make or brant'lı tıny draının to any of the said sewers so vested in the said Commissioners, or authorized to be inade under and by vu tuo of this Act of a larg size, or in a different manner and form of comiuuun"ution th an shall be directed or appointed by the said Surveyor, every person so offending shall fer every such offence forfeit and pay on conviction efore a Ma gistrate a sum not exceeding Fifty Rupees. XX. And whereas it would tend to insure a greater efficiency and economy in the execution of works if the same were executed by persons under the imunedliate difection and controul of the Surveyor of the said Commissioners, it is en at ted, that it shall be liwful for the said Commissioners to ontract and agree with the Owners of any houses or other tenements within the sud Town, that any drains required to be inade by such Owners shall be constructed and made by the Surveyor of the said Coinmissioners, and the cost price qf making such drains (as certified by the said Surveyor of the said Commissioners) shall be repaid by such Owners to the said Commissioners, and in default of such payment the same may be recovered in the manner hereinafter provided.
