( به دننه ) REPORTS OF SUMMARY CASES DETERMINED BY THE COURT OF SUDDER IDEWANNY ADAWLUT 3rd April, 1849 Claimants to property advertised for sale in ( xecution of a decree against a judgment debtor, cannot obtain its release by depositing the amount of the decree Dyamye Chowdhrann, l y and Jugodwmbha Chowdhnaim, In execution of a decrue, obtained by Tarapershad Roy Chowdhree, certain lands, situated in Zillahs Midnapoor and Jessore, were attached by the order of the Judge of 24 Pergunnalis The potationers alleged that the property was purchased by and bulonged to them The Judge of Zillah Midnapore rejected their claim, on appeal to the Sudder Dewanny Adawlut, his order was upheld Petitioners The petitioners then, in order to save the lands from sale, deposited the whole umount of the declee due to the decree holder before the Judge of Zillah Midnapore, who stopped the sale of the lands within his jurisdiction, and transmitted the money to the Judge of the 24 Pergunnahs The lands in Zillah Jessore bung, however, adv crtised for sale on the 5th March, 1849, the pe titioners applied to the Judge of 24 Pergunnahs to stay 1t, who refused, the decree-holden declining to take the petitioners' money, having no claim against the in, but only against the party cast, against whose property he would execute the de CTQU From the Judge's order, which was dated 9th February, 1849, the petitioners appealed to the Sudder IDuwanny Adawlut By the Court (Mr Jackson ) “The order of “ the Zillah Judge is quite proper, and there are * no grounds for interfering with it."
