( ১৪৪ ) mensem, and has been duly registered as hereins after provided, shall be entitled to vote. 6. At electious held in newly-created municipalities before municipal taxation has been imposed, every person qualified under rule 2 who— e (k1 has, during the year immediately preced ing the election, paid an amount of not less than 12 annas on account of chowkidari tax ; qr (2) being a member of a joint undivided family, one of the members, of which has, during the year preceding the election, paid an amount of not less than 12 annas on account of chowkidari tax, is a graduate or lioentiate of any University, or holds a certificate as a pleader or mooktear, or holds any office or employment carryiug a salary of not less than Rs. 50 per mensem, and who has been duly registered as hereinafter provided, shall be entitled to vote. Of the regustration of vote, e. 7A. In the oase of a first election in a newlyoreated municipality, the Magistrate shall, as soon as possible after the publication of the notification creating the muniolpality, cause to ba prepared a register of persons qualified to vote. Such register shall be prepared from the chowkidari assessment lists, from inquiries made by persons specially deputed for the purpose, and in such other manner as may appear expedient. For all subsequent elections in overy such municipality, the register shall be prepared or revised, as the case may be, by the Chairman of the municipality. B. When the name of any municipality has been removed from the first, sohedule of the Municipal Act under section 17, the Chairman of the Municipality shall, as soon as possible after the publication of the notification under the said section, oause to be prepared a register of persons qualified to vote. O. In every munioipality in which elections of Municipal Commissioners have already been held, the register of voters existing at the time of publication of these rules shall oontinue in force until revised as hereinafter provided. 8. Every register prepared or revised as hereinafter provided by the Chairman of a Municipality shall be submitted to the Magistrate before publication under the next succeeding rule. 9. At least six weeks before the date fixed for the general elections as hereinafter provided, an extract from the register, showing the persons [ Government Gazette, 2nd March 1886.] Paar IIA. qualified to vete within each Ward, shell be published by the Chairman, or, in the case of a newly-created municipality, by the Magistrate, at suitable places within that Ward if the municipality has been divided into Wards for the purposes of election. A copy of the whole register shall also be published at the municipal office, or, in the case of a newly-created municipality, at suoh place withun the municipality as the- Magis | trate, may direct. 10. The Magistrate shall sit at some place within the municipality to hear and decide objections to, and claims for, registration of voters on some date of which at least three days' notice shall have been given, and which shall be at least ten days after the publication of the lists in question, and at least one week before the date fixed for the commencement of the elections and such decision shall be final. 11. '1 he register as amended by the Magistrate after the hearing and decision of claims and objections shall be returned to the Chairman of the municipality if the original register was prepared by hum. It shall be considered as the final register of persons entitled to vote at the elections, and no person whose name does not appear In the register shall be permitted to vote. 12. The register prepared by the Magistrate for a newly-created munioipality shall remain un force until the expiry of the municipal year next succeeding the date of the first elections; and the persons whose names are entered in that register shall be entitled to vote at any by-election held within that period. 13. If it is necessary to hold a by-election in any such municipality after the expiry of the period specified in the last rule, the Chairman of the municipality shall prepare a register of voters for the ward in which the vacancy has occurred, If the municipality has been divided into wards, or 1f there has been no such division, for the whole municipality. 14. Rules 8 to 11 shall apply to the first byelection in each ward of every such municipality; in all subsequent cases the general rules for byelections as hereinafter provided shall be followed. 15. Except as above provided, it shall not be necessary to publish the register or extracts from the register on the oocasion of by-eleetions, provided that the register shall at all times be open to inspection by rate-payers at the Municipal office, and that all persons whose clams have been admitted under the succesding rules shall be entitled to vote at such elections."
